Terms of Service
Effective date: October 5, 2026
Welcome to Welzie Art Gallery, operated by Welzie Art LLC ("Welzie Art," "we," "us"), in Wailea, Maui, Hawaii. By placing an order, booking an art class, or using this site, you agree to these terms, our Refund and Return Policy, and our Shipping Policy. You must be at least 18 years old to place an order or book a class.
Ownership and rights
Welzie Art retains the copyright in every artwork, including the image of every original and every reproduction. When you buy a piece, you own that physical piece only. As the owner, you may display it, resell it, or give it away.
Without our written permission, you may not copy, scan, digitize, print, or create derivative works from the artwork, including by using AI tools. You may not use the artwork in any digital or blockchain format, including NFTs. Commercial use (including merchandise, advertising, licensing, reprinting, and AI training) requires our written permission. No license, express or implied, is granted except as stated in these terms.
These rights stay with Welzie Art after you resell or gift a piece. If you resell or gift your piece, you agree to share these terms with the new owner.
Sharing photos of your artwork
You are welcome to photograph your artwork in your space and share those photos on social media, as long as the sharing is personal and non-commercial and the artwork appears as part of a larger scene. Tagging @WelzieArt makes us smile. You may also include the artwork, as it appears in your home or space, in real estate or rental listing photos. This permission does not allow close-up or stand-alone images of the artwork for reproduction or resale, and we may withdraw it if it is misused.
Limited Edition Aluminum
Our Limited Edition Aluminum pieces are giclée reproductions printed on aluminum. There are 99 prints per size category that each title is available in. All sales count toward the same 99 in each size, whether the piece is sold online, in the gallery, or anywhere else. Edition numbers are assigned in the order payment is received. When an edition sells out in its size, it is no longer available, and we do not reproduce that title in that size in aluminum. There are no aluminum artist proofs at this time.
Matted prints are open editions and are not limited. We may continue to produce and sell them at any time.
Each original and each Limited Edition Aluminum piece is signed and comes with a Certificate of Authenticity.
Orders and pricing
All sales are final. Please see our Refund and Return Policy for the details, including how damage claims work. Prices are in US dollars. For online orders shipped to a Hawaii address, Hawaii General Excise Tax (GET) is calculated at checkout and shown as a separate line. Online orders delivered outside Hawaii are not charged Hawaii GET. Hawaii GET is added to purchases made in the gallery.
We may cancel and fully refund an order if there is a pricing error, if a piece or edition is no longer available, or if we cannot process your payment.
Shipping
All online orders are shipped, and we do not offer local pickup for website orders. Shipping timing, address confirmation and responsibility for entering a correct address, signature on delivery, storage of pieces we cannot deliver, freight for larger pieces, and international shipping are described in our Shipping Policy.
Commissions
The physical commissioned original is one-of-one. Welzie Art retains the copyright and the right to reproduce the image, including in limited editions, at our sole discretion. Commissions are arranged in person at the gallery and are governed by your signed Commission Agreement, which controls over these terms if the two conflict.
Art classes
Art classes are governed by the class policies we send when you inquire or book, and by our Refund and Return Policy. Your class invoice states that by paying it, you agree to the terms and conditions of Art Class.
Color and image accuracy
Colors, texture, and scale vary between screens and in person. Photos on this site are representative of each piece.
Limit of liability
To the extent permitted by law, Welzie Art's total liability related to an order is limited to the amount you paid for that order, and we are not liable for indirect, incidental, or consequential damages. Nothing in these terms limits any rights you have under applicable law.
Governing law and disputes
These terms are governed by the laws of the State of Hawaii. Any dispute will be resolved in the state or federal courts located in Maui County (Second Circuit), Hawaii, including small claims court where the amount qualifies. If you have a concern, please email us first so we can work it out.
General
We may update these terms from time to time. The version in effect when you place your order applies to that order. If any part of these terms is found unenforceable, the rest remains in effect. These terms, together with our Refund and Return Policy, Shipping Policy, and any signed Commission Agreement, are the entire agreement between you and Welzie Art regarding your purchase.
